An aggressive repeat offender man, subject to a deportation order, has been held in custody pending his trial after new incidents of domestic violence against his vulnerable partner.

“He was aggressive.” This is how the prosecutor of Castres, Élodie Buguel, described this 40-year-old man facing charges in court for denying domestic violence.

Previously convicted for similar offenses, this African national, residing irregularly in France and subject to an Obligation to Leave the French Territory (OQTF), was supposed to be judged for the usual blows and insults on his vulnerable spouse, a woman under guardianship, committed between November 2023 and April 2024 in Saint-Sulpice. It was actually the victim’s guardian who filed a first complaint last January. However, law enforcement had difficulty apprehending the man in his forties who resides in Montauban.

And even while knowing he was wanted, he continued to commit violence against the victim. He was finally arrested on April 5 and remanded in custody for an immediate appearance. But the accused requested time to prepare his defense.

Given his criminal record – seven convictions, mostly for aggravated violence – the risk of recidivism, and his lack of guarantee regarding his administrative status, the prosecutor requested his detention pending his trial, now postponed to May 7. “It is necessary to protect the victim,” the magistrate argues. “Especially since he shows no intention of ending the relationship. Everything is in place for an explosive situation if he is not kept in custody.” The court agreed with these requests.
