In Washington, about thirty soldiers and individuals wishing to enlist in the military have taken legal action to challenge their exclusion based on their gender identity.

At the heart of this case, named Talbott v. Trump, is a decree signed by President Donald Trump in January 2025 that aims to ban transgender individuals from serving in the American military.

The plaintiffs argue that this decision, deemed as unjustified discrimination, targets military personnel who are already serving in some cases.

Beyond challenging this measure, their goal is to have their case recognized as a class action lawsuit. This common procedure in the United States would ensure that the final decision applies to all individuals affected by this policy, not just the original plaintiffs.

This strategy is motivated by a recent development in U.S. law. A Supreme Court decision has limited the ability of judges to suspend a measure nationwide. Without class action recognition, a potential legal victory may only benefit the plaintiffs, leaving other transgender military personnel exposed to the ban.
